PhRMA submitted comments to the Office of the U.S. Trade Representative (USTR) regarding its investigation to determine whether acts, policies and practices of the Government of Brazil are actionable under Section 301 of the Trade Act. PhRMA’s submission identifies how Brazil fails to adequately and effectively protect the intellectual property of American biopharmaceutical companies, particularly due to the lack of regulatory data protection for biopharmaceuticals and the absence of patent term adjustment mechanisms to mitigate the excessive patent backlog.
